Updated 2026: Florida law now imposes criminal penalties for refusing a lawful breath or urine test after a DUI arrest. Under the amended Florida’s DUI refusal statute, a first refusal is now charged as a second-degree misdemeanor. A second or subsequent refusal is charged as a first-degree misdemeanor. These criminal penalties apply in addition to administrative driver’s license suspension and other potential DUI consequences.
